An FIR is a crucial step in the criminal justice process. The police are only allowed to begin their investigation once an FIR has been registered. Furthermore, the details within an FIR cannot be changed unless ordered by the Supreme Court or the High Court.
How to File an FIR
The procedure for filing an FIR is outlined in Section 154 of the Code of Criminal Procedure, 1973.
- If information about a cognisable offence is given orally, the police are required to write it down.
- As the informant, you have the right to have the information recorded by the police read back to you.
- Once the police have recorded the information, the informant must sign it.
- After confirming that the information recorded by the police is accurate, you should sign the report.
- Individuals who are unable to read or write should place their left thumb impression on the document to confirm its accuracy.
- If a copy of the FIR is not provided by the police, you have the right to demand one. It should be provided to you free of charge.
